Can I start marketed by Pharmaceutical company without Drug License?

I read your blogs. It’s very helpful for me now I have a question. I have a registered company and address in Delhi. Third party manufacturer made some product after my suggestion and I want in marketed by column he give my company name do I need any type of Licence. I am not keeping any Drugs on My premises. I am going to market search customer after that I take order and directly supply Drugs from manufacture to chemist. Only I need my company name and address as a marketed by, please help me and confirmed do I need any licence for the same.

Response:

Practically that is not possible to supply drugs directly from manufacturers to chemist. In that case manufacturer has to stock your marketed by product till you sell whole batch and this is not possible practically.

No manufacturer will do this. If in starting manufacturer agree to do that, after some time manufacturer will start to avoid this type of conditions.

Ethically you should have drug license if you are marketing any type of drug with your marketed by company name. But in starting if you don’t want to take license then you can appoint stockist having wholesale drug license at certain percentage. This is useful for short period but in long run, you have to take own drug license.

Query:

I have stockist who can take care the stock now can I put marketed by XYZ pharma my company name.

Response:

You can put but for short term. If in case drug office collect sample from market then that will depend at Drug Inspector whether they demand drug license with name of marketed by company or not. If they demand then you have to present or may have to face legal action.

So we will advise to take wholesale drug license before entering into own marketed by. One more reason of advising about own drug license that new law is implementing where marketed by company will be equally responsible for quality of drugs as of manufacturing company.
