Act and Regulations which covers Ayurvedic Medicines:
Ayurvedic medicines in India are regulated through Drug and Cosmetic Act & rules. Manufacturing, import, distribution and sale of ayurvedic medicines are regulated through this Act.
The guidelines for license to manufacture for sale of Ayurvedic (including Siddha) and Unani drugs are provided under Rule 154 and Rule 157 of the Drugs & Cosmetics Rules, 1945 and Rule 158(B) provides Guidelines for issue of license with respect to Ayurveda, Siddha or Unani drugs under section 3(a) & 3(h) (ii) of Drugs & Cosmetics Act 1940 and enforcement of these legal provisions of the Drugs and Cosmetics Act, 1940 and Rules, 1945 is vested with the concerned State Licensing Authority.
Drug and cosmetic act & rules specifies the requirements of taking manufacturing license for ayurvedic medicines but doesn’t specify any license or requirement for distribution of ayurvedic medicines , retailing of ayurvedic medicines and ayurvedic medicine company franchise.
We also submitted RTI to Ministry of Ayush for finding whether there is requirement of sales license for ayurvedic medicine or not. We got reply that you can check at link : Sales license required for ayurvedic medicine or not
After checking licenses under Drug and Cosmetic Act & rules, and asking from ayush ministry whether ayurvedic medicine‘s selling require any type of license or not.
In conclusion, it has been determined that a license for manufacturing Ayurvedic medicines is the only required, and no drug license is necessary for the sales and purchase of Ayurvedic medicines.
Qualification for open Ayurvedic Medical Store:
As there is no drug license required for selling of ayurvedic medicine, so there is no requirement of specific qualification for starting an ayurvedic medical store.
